Cake Agreement
Thank you for allowing me to be your cake decorator. Your trust in and business with me is important to me. My goal is for you to be completely satisfied with your cake from OKC Cake Lady/Exquisite Wedding Cakes by Nicole®.
The following is the agreement between
You
(“You”, “Your”, “Customer”, “Cake Customer”, “Client”)
and
The Cake Decorator
(“I”, “Me”, “My”, “We”, “OKC Cake Lady®”, OKC Cake Lady/Exquisite Wedding Cakes by Nicole®“)
As your Cake Decorator, I agree to deliver the above mentioned cake in a timely and mutually agreed upon manner, which is contingent on the following conditions:
A deposit of 50% is required to consider this an order and agreement for the above-described services. Deposits are NON-REFUNDABLE AND NON TRANSFERABLE for and reason. Any changes to Your order must be made at least six (12) weeks prior to delivery/pickup date.
Date changes must be made 180 days prior to delivery /pick up date. OKC Cake Lady® must have availability to schedule Your new requested date.
The Cake Customer agrees that there will be no changes such as themes, colors, or size reduction, etc., to the cake request after six weeks before the pickup/delivery date. You may, however, request to upgrade order.
The size of the tiers will be adjusted to accommodate the correct number of servings based on an industry standard slice of eight (8) cubic inches, four (4) inches high, one (1) inch wide and two (2) inches deep. OKC Cake Lady's cakes are not responsible for shortage of cake due to incorrect guest counts or failure to cut industry standard sized slices. If You need a cutting guide please inform me prior to pick up/delivery.
The inspiration and ideas drawn in Client's sketch(es) or images provided to OKC Cake Lady® are presented as representations of the cake(s). The actual product may vary based on the designer’s creative interpretation or structural necessity of the cake(s), while maintaining the integrity of the overall look of the cake(s). I will not copy another cake decorator’s work exactly. I will, however, keep it very similar.
Refunds requested due to style, decorations, color/shade/tint, size of decorations or misunderstanding about the design, misunderstanding of the overall general design concept, ordering a flavor you did not like or failure to order what you actually wanted, imperfections caused by weather, heat, humidity, rain, ice, freezing, snow, or other factors beyond our control will not be honored.
Payment can be made via OKC Cake Lady's website, cash, or credit card. Credit card/cashapp payments taken in person are subject to a $10 processing fee.
OKC Cake Lady® promises a product of high quality and service, but is not liable for unforeseen circumstances, including but not limited to inclement weather, transportation problems, illness, accidents, labor disputes or strikes, Acts of God, and other causes beyond reasonable control. A delay in transit shall not constitute grounds for a discount or refund.
OKC Cake Lady's cakes products may contain or come in contact with milk, wheat, nuts, cocoa or other allergens. While every precaution will be taken in the cases of known allergies, it remains the full responsibility of Client to inform their guests of possible allergens. OKC Cake Lady® is not responsible for any allergic reactions.
Black frosting is made using cocoa (chocolate) to help with the after taste of the black dye. Please keep this is mind if any of the party has an allergy to chocolate. You agree to notify your guests of this risk and hold OKC Cake Lady® harmless for allergic reactions.
Client assumes full responsibility for making sure all nonedible cake décor, including but not limited to, name tags, items standing up on or off of the cake(s), sugar flowers, etc. Please make sure these items are removed from the cake before it is cut and served. These items are may be made from edible materials, but are not intended for consumption, such as wires and skewers which are added for strength and flexibility to achieve the desired appearance of the cake(s). Thus, DO NOT EAT DÉCOR. You can always call the number provided if you are not sure. Please place cakes away from guest, especially children, as they may pull items off of cake and consume. It can be a hazard and OKC Cake Lady® is not responsible.
The color's blue, pink, and purple or any shade of these colors cannot and will not be guaranteed. These colors are very unstable and tend to fade and/or bleed into surrounding colors of frosting. Cakes with these colors left in sunlight for more than 10 minutes can result in a bleached look of that specific color.
If fresh flowers will be used on the cake it is the responsibility of the florist to determine flower safety and safe food practices and not the OKC Cake Lady®. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. I will do my best with cover steams before inserting into the cake.
Flowers (real or artificial), toppers, toys, plastic figures, nameplates, custom numbers, and/candles are not included or provided by OKC Cake Lady®. You can drop any of these items off to me and I can place on the cake before pickup or at delivery.
On occasion, I will photograph the cake/cakes and I reserve the right to use any photographs for display or promotion without compensation to the client.
It is Your responsibility to check the cake upon pick up or delivery. Once You leave with Your cake or the delivery person leaves Your premises, No Refunds will be given. OKC Cake Lady® is not responsible for how Your cake is handled, where you place the cake(s), or what you do with the cake(s) once the cake is delivered or picked up.
You shall provide clear driving directions to the desired delivery location and inform OKC Cake Lady® of any adverse road hazards and/or obstacles that may damage the finished cake (ex. Unpaved roads, roads with large hills, etc.).
In the case of an unavoidable situation, such as a car accident or poor road conditions during delivery OKC Cake Lady® cannot be held liable for more than the cost of the above ordered cake.
The Cake Customer or a representative must be at the cake delivery location at the arranged time of the delivery. OKC Cake Lady® will give up to a 30 minute grace period to allow the Client to arrive. Any time greater than 30 minutes will result in Your cake being picked up by the Cake Customer or the Customer representative at a location of OKC Cake Lady’s choosing.
OKC Cake Lady® is not responsible for any damage to the cake after setup is complete. You are responsible for providing an appropriate and secure table and friendly environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 73 degrees or below.
Outdoor Delivery Disclaimer: Client understands that OKC Cake Lady® is not responsible for the condition of products following outdoor setup. Due to the effects of outdoor weather conditions, table not being on level ground, wind blowing, undesirable atmospheric items (e.g., dirt, leaves, or branches), sunlight, insects and other wildlife, it is understood that products such as icings, fillings, cake decorations, etc., may not hold up and cannot be insured past satisfactory delivery.
Accidents/Weather – While OKC Cake Lady/Exquisite Wedding Cakes by Nicole® take my responsibilities very seriously, there may be some extreme conditions, such as accidents or inclement weather, which may prevent fulfillment of our obligation. Please keep your contact information and alternate contacts up-to-date so that we may notify you of any situation that may have occurred or may be anticipated. With good communication, there is a much better chance of working out a reasonable solution to any situation.
FULL REFUNDS: If OKC Cake Lady® fail to deliver or fail to have your cake ready for pick up on the agreed date and time specified, but not including events of mother nature that may prevent delivery until a later date, this will be the only reasons for a FULL refund.
DISCLAIMER: By paying for this cake you agree that certain creative changes may be made to your final design for the sake of stability, structural integrity or other certain emergencies. Also, your payment for this cake is an act of signing this agreement which is legally binding.
